Johannesburg - Former crime intelligence boss, Richard Mdluli, and his co-accused, Mthembeni Mthunzi, are expected to again appear in the High Court sitting at the Palm Ridge Magistrate’s Court on Thursday.

The pair are facing charges of intimidation, kidnapping, assault with intent to do grievous bodily harm, and defeating the ends of justice, relating to the 1999 death of Oupa Ramogibe.

Mdluli and Mthunzi have asked the court to discharge them. On Wednesday, Judge Ratha Mokgoatlheng reviewed evidence rendered by Ramogibe’s family on circumstances around his death.

According to the evidence under review, Ramogibe, who had married Mdluli’s former girlfriend, had reported to the police that he was receiving death threats. A case of attempted murder was opened by the police before Ramogibe was killed.

At the time, Mdluli was the station commander of the Vosloorus Police Station in Boksburg, east of Johannesburg, and was accused of sabotaging the investigation. Mdluli denied the allegations.

However, in November 2012, an inquest into the killing of Ramogibe cleared Mdluli of any involvement in the murder.

The charges of kidnapping and assault relate to allegations that Mdluli intimidated and assaulted the family and friends of his ex-girlfriend to find out where she had moved to when she got married.

The former intelligence head allegedly tried to find out from the family, at which home affairs office his ex-wife has tied the knot with Ramogibe, and where the couple was staying.

Mdluli has since approached the courts to discharge him on charges of kidnapping and assault.
