The SA Human Rights Commission has launched an investigation into illegal mining incidents at Stilfontein after receiving multiple complaints from community members and organisations about alleged human rights violations.

The issue gained public attention when police launched Operation Vala Umgodi, an effort to remove illegal miners from abandoned mine shafts in the area.

The commission’s decision to investigate was driven by serious concerns from the community and key stakeholders, Commissioner Adv. Sandra Mokhoasha told SABC News. The inquiry will examine policies on artisanal mining, its impact on local communities, and the methods used in Operation Vala Umgodi.

“This decision was based on the scale of events in Stilfontein and the continuous complaints we have received from community members, organisations, and NGOs,” Mokhoasha said, adding the inquiry would explore concerns about the “spirit of Vala Umgodi” and its broader implications.


A key focus will be determining whether human rights violations occurred during the operation and who should be held accountable. Complaints suggest local residents have suffered due to illegal mining activities, prompting the commission to assess the humanitarian impact.

Mokhoasha also noted concerns about South Africa’s policy framework on artisanal mining, questioning its effectiveness and impact on affected communities. “We need to evaluate how artisanal mining is managed and what its consequences are for surrounding areas.”

Another critical aspect of the inquiry is the conduct of Operation Vala Umgodi. The commission will investigate whether the operation adhered to constitutional human rights standards and whether law enforcement acted appropriately. Stakeholders, including the police, will be called to provide accounts of the operation.

Mokhoasha admitted to ongoing debates about accountability for the humanitarian crisis in Stilfontein, particularly concerning the loss of life and the welfare of those involved in illegal mining. The commission aims to ensure policies are in place to prevent similar crises in future and to safeguard the lives of miners, both legal and illegal.
