The case against a former senior North West traffic official has been postponed following his appearance in the Bafokeng Magistrate's Court on 23 September 2022.

The provincial National Prosecution Authority's (NPA) spokesperson, Henry Mamothame, says the former senior official of the North West traffic department, Levy Ikaneng, has been charged with two counts of negligent driving and failure or refusal to give blood and breath samples. Both charges contravene the Road Traffic Act. He says the accused pleaded guilty to both charges after the state argued successfully against his application to have the matters struck off the court roll.

“A case against Levy Ikaneng, a former senior official at the Provincial Traffic Department, was postponed to 19 November 2022 for judgment. We are hoping for a favourable outcome in our endeavour to demonstrate that we discharge our mandate without fear or favour,” he said.

He adds that Ikaneng was arrested on 23 April 2016, after he had knocked down a man with a Volvo sedan in Tlhabane.

“Upon his arrest, he refused to have his blood/breath samples taken as he was suspected to be driving under the influence of alcohol. The pedestrian, who was knocked down by Ikaneng, is now said to be confined to a wheelchair because of the incident. The matter was brought to the NPA’s attention by the family through a complaint after the docket was mysteriously closed without being handed over for prosecution,” says Mamothame.

According to Mamothame, Advocate Cavin Mphanga took it upon himself to probe the matter with the police and three years later it was brought back into the criminal justice system for prosecution. He adds that Ikaneng is currently out on a warning and the court warned him to be present in court when the matter goes for judgment.
