A private company in the Northern Cape and its director are in hot water.
According to the National Prosecuting Authority's (NPA) spokesperson, Mojalefa Senokoatsane, the entity has officially charged the Batsha Ba Tiro Financial Management company and its director, Marius Bocks, with two charges of fraud.
Senokoatsane says it is alleged that on two occasions the accused submitted false tax returns, amounting to more than R22 million.
The case is set for 17 August 2022, where the accused's legal team is expected to make representations.
“During the first instance, the accused submitted a false VAT return to the South African Revenue Service (SARS), on which undue input tax amounting to more than R8 million was calculated and claimed by the accused.
"In the second incident, during the 2018 tax year, the accused submitted a false Company Income Tax (CIT-14) return, which was calculated to be worth more than R13 million. This claim resulted in an incorrect income tax liability and an undue refund to the accused,” Senokoatsane adds.
It is alleged that the accused, who is registered as a vendor with the SARS, was obliged to submit a Remittance of Value Added Tax (Tax Returns), and on two occasions the taxpayer submitted two false tax returns, amounting to more than R22 million.
