Service provider ordered to return Free State municipal equipment─── KEKELETSO MOSEBETSI 12:01 Wed, 30 Oct 2024
The Free State High Court has ordered a contractor to reinstall essential components and systems to restore water supply to Brandfort and Theunissen.
Masilonyana Municipality took legal action against Seaben Trading and Projects for removing critical equipment from pump stations and water treatment plants, and keeping keys after payment disputes. The court granted the order on Tuesday (29/10).
Residents of Theunissen, Brandfort, and Winburg have faced unreliable water access for several weeks, negatively impacting their daily lives, affecting schools, clinics, and local businesses.
The crisis worsened after municipal workers initiated a strike, demanding the resignation of Mayor Dimakatso Modise amid reports of conflict between her and the chief financial officer.
According to court documents, the judge ordered Seaben’s owner to immediately reinstall all necessary components and systems to ensure the municipal water reticulation system operates effectively.
The document further stipulated that the contractor may also not disconnect, limit, or infringe on the municipality’s water supply until the payment dispute is resolved. At the same time, he must return all pump station and water treatment plant keys.
Furthermore, Seaben Trading and Projects must provide detailed invoices and documentation to the municipality’s legal team within ten days to substantiate its payment claims.
