Action SA to lay charges against G4s and the state─── 06:22 Tue, 25 Apr 2023
ActionSA along with the Mpholo and Bereng families will lay criminal charges against G4S and the Free State Health Department today.
ActionSA Free State Provincial Chairperson Patricia Kopane says they will officially lay the charges at 11:00 at Park Road Police Station, Bloemfontein
- Kopane adds the charges will be laid for the following reasons:
The state and/or its officials and/or G4S and/or Correctional Services have contravened the National Health Act No 61 of 2003, by contravening the regulations as set out in Government Gazette No 636 (No. 30075) pertaining to the Regulations Regarding the Rendering of Forensic Pathology Service, and in particular Regulations 5, 6, 8, 10, 11, 13, 14, 20, 26, 30, 32, and 39. - The State and/or its officials and/or G4S and/or Correctional Services have contravened the National Health Act No 61 of 2003, by contravening the regulations as set out in Government Gazette No36473 of 22 May 2013, pertaining to the Management of Human Remains and Chapter 4, Regulation 12, and Chapter 10, Regulations 29 and 32.
“Inter alia, the unlawful conduct includes the unlawful removal of Katlego Junior Bereng’s body from the location at which his body was found, to an unknown mortuary, and then to the prison cell of Thabo Bester, to defeat the ends of justice and unlawfully allow Thabo Bester to escape under fraudulent means” Kopane concludes.
