Suspended ANC Secretary-General, Ace Magashule, is set to approach the Supreme Court of Appeal in a bid to have his corruption charges scrapped.

Magashule is challenging a judgment by the Free State High Court to dismiss the asbestos corruption charges against him.

The lower court ruled against him at the end of last month.

“I can confirm that the [suspended] secretary-general of the ANC did appeal the decision that was taken by the High Court in Mangaung to the Supreme Court,” Magashule’s close ally Carl Niehaus said on Monday. “There’s nothing more I can say about it.”

Magashule, businessman Edwin Sodi, and other co-accused are questioning the legality of the case against them.

Magashule and 15 co-accused, which includes five companies, are facing charges relating to the alleged R255 million asbestos tender fraud in the Free State.

The allegations stem back to Magashule's time as premier of the Free State.

The group claimed there was no validity to the State's case but the court dismissed the legal challenge.
