The legal battle between the troubled Bloemfontein-based Mangaung Metro Municipal council, which removed the former Acting City Manager (CM) by means of a motion, is now ensuing.

Sello More is slapping the Metro with an urgent court bid to review and set aside its decision to remove him from office. More wants the High Court to review and set aside the council’s decision, and to interdict the appointment of a new acting city manager. 

More says the decision by the council was not communicated to him. 

OFM News previously reported that a source said the motion to remove More was an irregular one, since More is just an accounting officer and not a politician in council.

The source says what the council should have done, was to write to More and issue a letter to suspend him, pending an investigation. This source suspects that More was just used as a sacrificial lamb to settle a political score within the majority party in the council.

More’s legal representative, MC Radebe, says their client considered the decision by the council as unlawful and susceptible to being reviewed and set aside. More remains the acting city manager pending the finalisation of the urgent court application,” MC Radebe adds.

More was supposed to act in his position until 31 January, since the post of city manager was advertised by the metro.

The SABC reports that the move comes after the Supreme Court gave an order that More's appointment by the MEC for Cooperative Governance (Cogta), Mxolisi Dukwana, was illegal. It's understood that the acting City Manager is now Tebogo Maine.
