The Bloemfontein-based Supreme Court of Appeal (SCA) in the Free State has set aside and declared as unconstitutional and unlawful the ANC's provincial conference which was held in May 2018.
This is where MEC for Roads and Transport, Sam Mashinini, was elected as the chairperson of the party; and Agriculture MEC William Bulwane as his deputy.
A disgruntled group of ANC members took the matter to the SCA after a High Court Judge dismissed its bid to have the elected structure declared illegal and unconstitutional in 2018. On Wednesday, the SCA upheld the leave to appeal the bid with costs and said the provincial conference was held in violation of a court order of 29 November 2017.
Former MEC, Sekhopi Malebo, previously told OFM News that the Branch General Meetings (BGMs) were illegally constituted because those who attended the Ilanga Estate conference were those from the nullified 2017 Nasrec delegation, which emanated from the Parys conference.
In 2018, the High Court Judge Fouché Jordaan dismissed the group's bid to overturn the validity of the conference and said he did not believe this group had a solid case against the PEC, and believed that they made the court bid to score political points within their faction. Malebo at the time said even though Jordaan dismissed their application he felt that the judge erred.
OFM News previously reported that the group was challenging the elective conference where Mashinini was elected ANC Chairperson in the province, William Bulwane Deputy Chairperson, and Paseka Nompondo the Secretary.
