The North West MEC of Education has been ordered to pay damages after she neither denied nor contradicted evidence that a Grade R learner was hit on the hand.
The mother of the then-six-year-old requested R7 million in damages for pain and suffering, future medical costs, and loss of life’s comforts. But she was R6.97 million less on Tuesday (10/12).
The North West High Court in Mahikeng ordered Viola Motsumi to pay R30 000 in damages after a primary school teacher hit the learner with a knobkierie in 2015.
“As the provincial department of education we are aware of the court order that mandates the MEC to compensate R30 000 for damages caused to a learner,” said spokesperson Mphatha Molokwane.
“The matter originates from the year 2015 after a teacher hit a grade R learner with a knobkierie.”
Handing down judgment, Judge President Ronald Deon Hendricks said it’s important to note the child did not lose the use of his hand.
“Yes, he suffered pain and discomfort for approximately two weeks in total, and received medical treatment at a clinic and in hospital, (but) there is no evidence of any permanent disability.”
‘The case was brought to the high court in 2018’
News 24 reports the mother took the child to the clinic and was referred to a hospital for further treatment. She claimed since the incident, the child had learning difficulties, anxiety, and fear due to trauma which also affected his development.
The case was brought to the high court in 2018, three years after the assault took place.
OFM News previously reported educators who continue to administer corporal punishment or use harmful practices like name-calling would be prosecuted. Such behaviour can lead to severe psychological consequences for learners, including suicide, said Free State departmental legal advisor Adv. Zukile Ntshwanti.
