ActionSA in the Free State has praised Magistrate Estelle de Lange’s judgment in Thabo Bester's girlfriend's bail application.
ActionSA Provincial Secretary Patricia Kopane said De Lange’s decision to refuse Nandipha Magudumana's bail has restored the reputation of the justice system. It also restored the dignity of Katlego Bereng whose charred body was used by Bester and some of his co-accused to escape the Mangaung Correctional Centre.
Kopane said that together with the Bereng family they felt relieved by the judgment.
“Even last week listening to her affidavit (one could sense that) she was ill-advised, nothing was honest from her.
“She claimed she was abducted but we remember when she arrived in South Africa she said she was illegally arrested. She took the state to court to say she was illegally arrested and then she was suddenly abducted.
“She left the country having three passports and she did not use any of (them). So it clearly shows that Nandipha is behind this. She is the mastermind. So if she can be given bail she is going to start again trying to make sure that another Katlego is used.”
Kopane has been a regular in the Bester escape court cases since April 2023. She recently called for a lengthy jail term for all the accused. Twelve people. including Bester, former G4S security officials and Magudumana’s father, stand accused of aiding, abetting, defeating the ends of justice, fraud, corruption and violating a dead body.
Kopane recently accompanied the father of Bereng, Batho Mpholo, to open a case against G4S and the Department of Health after it was established that Magudumana fraudulently claimed his body from the National Hospital.

She allegedly claimed the body was that of another accused, Zanda Moyo’s brother. On Monday, Magudumana’s lawyer Advocate Machini Motloung said they have met with Magudumana to consult and plan a way forward. It's understood they could be heading to the High Court to have her bail refusal overturned.
Free State NPA spokesperson Phaladi Shuping said they were satisfied with De Lange’s decision to deny Magudumana bail.
