Mining company Jagersfontein Developments by law must take responsibility for any pollution from the disaster.
The company's legal compliance officer, Marius de Villiers, says the company is working with independent and government engineers to determine what exactly happened.
Charlesville residents say their complaints about the Jagersfontein dam fell on deaf ears.
On Sunday, houses were swept away and others were damaged when the dam wall collapsed.
The incident left over 300 people homeless. One person was killed.
Local resident, Pienkie Michaels, says the most recent mine owners are not the only ones to blame.
He believes responsibility should be shared by current and previous owners, including De Beers and Dubai-based Stargems.
