The North West Provincial Government has failed to appeal the Labour Court’s decision to reinstate the embattled head of the ailing Health Department, Thabo Lekalakala.


Despite the office of premier Job Mokgoro’s promises that it would file papers on Friday, his spokesperson, Vuyisile Ngesi, confirmed to OFM News on Tuesday afternoon that the legal team is still busy drafting papers. He could not confirm whether Lekalakala was back at work or not.

Lekalakala, at the eleventh hour, lobbied for the court to reinstate him with immediate effect - despite his on-going internal disciplinary hearings.

Ngesi says the team will also wait for the premier to sign off on the papers and this might take some time to be concluded.

“Following the ruling by the Labour Court in the case of Lekalakala, we are busy drafting papers. We will be filing papers before the court very soon,” says Ngesi.

Ngesi previously told OFM News that the premier was shocked and surprised to learn of Lekalakala's reinstatement. He was not afforded the opportunity to oppose the reinstatement. The departmental spokesperson, Tebogo Lekgethwane, also previously told OFM News that Lekalakala is charged with procurement irregularities involving the payment of R30 million to the Gupta-linked Mediosa Company and misrepresentation of facts after he stated he had worked as a chief director of the department.

Ngesi says during Lekalakala’s disciplinary hearing, on Tuesday and Wednesday, he applied to the court on an urgent basis and his application was unopposed.
