Poultry feeding equipment makers prosecuted | News Article

Two companies manufacturing and supplying flat wire will feel the pinch of the Competition Commission of South Africa.


Technical Systems (Pty) Ltd and CGC Industries (Pty) Ltd, trading as RTS Industries (Pty) Ltd, face charges relating to the division of markets by allocating territories.

The Commission’s spokesperson, Sipho Ngwema, told OFM News that in 2014 Technical Systems sued RTS and its owner, in his personal capacity for breaching the 2009 restraint agreement.

Ngwema further says this after the owner resigned in 2009 and signed a three-year restraint of trade agreement.

Ngwema says this conduct is in contravention of the Competition Act.

“These are the only two companies ironically in this particular sector and therefore the elimination of the other one would have resulted or would result in only one supplier or company being able to offer the services to the industry. We fine companies on a daily basis. We have [imposed massive] fines in terms of anti-competitive conduct, particularly the abuse of dominance,” says Ngwema.
