Studies show the current marriage law of South Africa is not inclusive and responsive to the realities.


The Minister of Home Affairs, Aaron Motsoaledi, will be discussing a new policy of marriages with the National Khoi-San Council in Bloemfontein in the Free State on 22 November 2019. The Free State premier, Sisi Ntombela, is also expected to address the meeting.

Home Affairs spokesperson, Siya Qozi, says they have reached out for opinions on the new marriage policy and the department met with academics, religious leaders, cultural groups and so forth. Individual members of the community will also be given a chance to have a say in the policy in March next year.

A research study by Waheeda Amien, associate professor in law at the University of Cape Town, says the absence of laws pertains to minority religions in South Africa. Muslims make up 2% of South Africa’s population, Hindus 1% and Jews 0.2%. This is no excuse for the failure of the government to protect them. The failure to recognise religious marriages in South Africa may point to a lack of political will.
