FS clan looks to inauguration as court dismisses Chieftaincy challenge | News Article

The Bloemfontein High Court has today dismissed an application challenging the findings of a 2017 report by the Free State Provincial Government into the decades-long chieftaincy row of the Barolong Boo Seleka clan with costs.


The clan tells OFM News outside the High Court, they can now look to the future again and work on improving Thaba’Nchu for the better.

The report in question was based off of a probe by the Commission on Traditional Leadership, Disputes and Claims and was released by then Free State Premier and current ANC Secretary-General Ace Magashule in November 2017. The applicant in the matter, Moipone Moroka, a senior traditional healer, cast doubt on the legitimacy of the probe, alleging the House of Traditional Healers was not adequately consulted by the Commission. Represented by Andries Petrus Berry in proceedings on July 29, the applicant further disputed the findings in the report which found in favour of Kingsley Moroka, a direct descendant of Kgosi Moroka, as opposed to Gao Moroka (wife of the late Albert Moroka) who had been requested by members of the clan in 2014 to step down and allow Kingsley Moroka to take the throne.

Magashule was accused by the clan of sitting on the report for three years, something which the Premier’s office vehemently denied at the time. While the clan alleges the Commission was done with their investigation in November 2014 already, Magashule’s office said they only received the outcomes of the investigation in April of 2016.

A representative for the tribe, Thabiso Nyane, tells OFM News they are looking forward to the inauguration of Kingsley Moroka and see this as the beginning of a new dawn for Thaba’Nchu. “We have been so grey in Thaba Nchu, there were no developments, money meant to develop the community was misused. Now everything will be redirected to improve the lives of our people,” says Nyane optimistically.

Following the judgment, members of the community could be seen huddled together outside the High Court, discussing the way forward.
